Agreement
This End User License Agreement (“EULA”) is an agreement between you and KuyaPoy LLC (“KuyaPoy,” “we,” “us,” or “our”) for the Hitsura application, its updates, documentation, and included materials (collectively, the “Software”). By downloading, installing, or using the Software, you agree to this EULA. If you do not agree, do not install or use Hitsura.
License grant
Subject to this EULA and any purchase terms presented when you acquire Hitsura, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control. You may use Hitsura to create personal or commercial projects unless a separately identified included asset carries a more restrictive license.
The Software is licensed, not sold. Rights not expressly granted to you are reserved by us and our licensors.
Your projects and output
As between you and KuyaPoy LLC, you retain the rights you have in original models, textures, materials, project files, and other content you create or import. We do not claim ownership of your original work merely because you used Hitsura to create or edit it.
You are responsible for having permission to use imported content and for complying with the licenses of third-party materials, fonts, models, textures, or other assets. Included sample or starter assets may have separate terms identified with the asset or in accompanying notices. Keep backups of important project files.
Restrictions
Except where applicable law expressly permits it, you may not:
- copy, redistribute, sell, rent, lease, sublicense, or commercially host the Software;
- reverse engineer, decompile, disassemble, or attempt to derive its source code;
- modify the Software to bypass licensing, security, or technical limitations;
- remove or alter copyright, trademark, attribution, or proprietary notices; or
- use the Software to violate law or another person’s rights.
Ownership
Hitsura, including its code, interface, artwork, branding, documentation, and other included content, is owned by KuyaPoy LLC or its licensors and is protected by intellectual property laws. This EULA does not transfer title or ownership to you.
Third-party components
Hitsura may include open-source or third-party components governed by their own license terms. Those terms apply to the relevant components and are provided in the Software’s notices or documentation. If a third-party license conflicts with this EULA for that component, the third-party license controls for that component.
Updates and online services
We may provide updates, patches, or new versions, but are not obligated to do so unless required by law or separately promised. An update may replace or supplement the Software and may be subject to updated terms. Optional online features may require internet access and may change or end over time.
Purchases and refunds
If you purchase Hitsura through a third-party storefront, that storefront handles payment and refunds under its rules, subject to applicable consumer law. Any subscription, renewal, or additional paid feature will be disclosed before purchase. This EULA does not limit rights that cannot legally be waived.
Disclaimers
To the fullest extent permitted by law, Hitsura is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted and error-free operation. You are responsible for testing output and maintaining backups before relying on the Software in production. Some jurisdictions do not allow certain exclusions.
Limitation of liability
To the fullest extent permitted by law, KuyaPoy LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, projects, business, or goodwill arising from Hitsura. Our total liability will not exceed the greater of US $100 or the amount you paid for Hitsura during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.
Termination
This EULA remains effective until terminated. You may terminate it by uninstalling and ceasing use of the Software. Your license terminates automatically if you materially breach this EULA. On termination, stop using and delete copies of Hitsura, except where retention is permitted by law. Sections concerning ownership, restrictions, disclaimers, liability, and general terms survive.
General terms
You must comply with applicable export-control and sanctions laws. You may not transfer this EULA without our written consent, except where applicable law permits. We may assign it as part of a merger, reorganization, or sale of the business. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect.
This EULA, the Terms of Service, and any purchase terms presented to you form the agreement concerning Hitsura. Mandatory consumer protections in your place of residence continue to apply.
