Agreement to these terms
These Terms of Service form an agreement between you and KuyaPoy LLC (“KuyaPoy,” “we,” “us,” or “our”). By accessing or using any product or service that links to these terms, you agree to them. If you do not agree, do not use the applicable product or service.
If you use a service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.
Services covered
These terms apply to current and future KuyaPoy websites, apps, games, music, downloads, digital content, product pages, communications, online features, and related products and services that link to these terms (collectively, the “Services”).
Certain Services may include additional product-specific terms, end-user license agreements, or notices presented with the Service. For example, Hitsura and AniHito are governed by the applicable Hitsura EULA or AniHito EULA. If these terms conflict with additional terms about use of a particular Service, those additional terms control for that issue.
Eligibility
You must be legally able to enter into this agreement. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these terms for you. The Services are not directed to children under 13.
Acceptable use
You may not use the Services to:
- break the law, infringe another person’s rights, or facilitate harmful activity;
- interfere with, damage, overload, or bypass security for the Services;
- introduce malware or attempt unauthorized access to systems, accounts, or data;
- misrepresent your identity or falsely claim an affiliation with KuyaPoy; or
- copy or exploit website content except as permitted by law or written permission.
Purchases and refunds
Prices, taxes, payment timing, and renewal terms will be presented before a purchase. Except where required by law or expressly stated at the time of purchase, all sales are final and no refunds are offered. Purchases through a third-party storefront are also subject to that storefront’s payment and refund rules. Nothing in these terms limits consumer rights that cannot legally be waived.
Ownership and feedback
The Services, including their software, artwork, text, design, trademarks, and other content, are owned by KuyaPoy LLC or its licensors and are protected by applicable intellectual property laws. These terms do not transfer ownership to you.
If you voluntarily send suggestions or feedback, you allow us to use them without restriction or compensation. This does not give us ownership of your underlying creative work or personal files.
Third-party services
The Services may link to or rely on third-party websites, storefronts, platforms, or tools. Those providers operate under their own terms and privacy practices. We are not responsible for third-party services we do not control.
Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We do not guarantee uninterrupted availability, error-free operation, compatibility with every device, or that all information will always be complete or current. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, KuyaPoy LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from the Services. Our total liability for a claim will not exceed the greater of US $100 or the amount you paid us for the applicable Service during the 12 months before the event giving rise to the claim.
These limitations do not apply where prohibited by law, including to liability that cannot legally be limited or excluded.
Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access if you materially violate these terms, create risk or harm, or if we discontinue a Service. Terms that by their nature should survive termination—including ownership, disclaimers, and liability limitations—will continue to apply.
Changes to these terms
We may update these terms as the Services or legal requirements change. The updated date above identifies the current version. When a change materially affects an online account or paid service, we will provide additional notice when reasonably required. Continued use after an updated version takes effect means you accept the updated terms where permitted by law.
